1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Tarkify, including our website, applications, features, and related services.

By accessing or using Tarkify, you agree to be bound by these Terms and any applicable policies referenced within them.

If you are using Tarkify on behalf of an organization, you represent that you have authority to accept these Terms on that organization's behalf.

2. Eligibility

You may use Tarkify only if you are legally permitted to enter into these Terms and are permitted to use the service under applicable law.

Tarkify is not intended for individuals who are below the minimum age required to use the service under applicable law.

We may restrict or terminate accounts if we reasonably believe an account does not meet applicable eligibility requirements.

3. Your Account

Some Tarkify features require you to create an account. You are responsible for providing accurate information and keeping your account information up to date.

You are responsible for maintaining the security of your account credentials and for activities that occur through your account.

You should notify us promptly if you believe your account has been compromised or accessed without authorization.

4. User Content

Tarkify allows users to create and share content including debates, arguments, comments, profile information, images, and other material ("User Content").

You are responsible for the User Content you submit, publish, or otherwise make available through Tarkify.

You represent that you have the necessary rights and permissions to publish the content you submit.

You must not submit content that violates applicable law, infringes another person's rights, or violates these Terms or our Community Guidelines.

5. License to User Content

You retain ownership of the User Content you create and submit to Tarkify, subject to the rights you grant to us under these Terms.

By submitting User Content to Tarkify, you grant Tarkify a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically process that content as reasonably necessary to operate, maintain, promote, and improve the service.

This license does not mean that Tarkify owns your User Content.

You can remove content from Tarkify where the applicable feature allows you to do so. However, copies may remain where reasonably necessary for backups, security, legal compliance, dispute resolution, or other legitimate operational purposes.

6. Community Rules and Prohibited Conduct

Tarkify exists to encourage discussion and the exchange of different perspectives. You agree to participate responsibly.

You must not use Tarkify to:

• Harass, threaten, or intimidate other people
• Promote violence or credible threats of harm
• Publish unlawful or fraudulent content
• Impersonate another person or organization
• Engage in spam or deceptive activity
• Manipulate votes or engagement through artificial means
• Create accounts for abusive or deceptive purposes
• Attempt to gain unauthorized access to accounts or systems
• Distribute malware or other harmful software
• Infringe intellectual property or other legal rights
• Publish private information about another person without authorization
• Use automated systems to abuse or overload the service
• Attempt to circumvent moderation or security systems
• Otherwise misuse Tarkify in violation of applicable law

7. Voting and Engagement

Tarkify may allow users to vote, react, comment, save, share, or otherwise interact with content.

Engagement features are intended to represent genuine user participation.

You must not artificially manipulate votes, rankings, engagement, or visibility through bots, fake accounts, scripts, coordinated abuse, or other deceptive methods.

Tarkify may remove fraudulent or manipulated engagement and may take action against accounts responsible for such activity.

8. Content Moderation

Tarkify may review, moderate, restrict, remove, or limit access to content or accounts when we reasonably believe that they violate these Terms, Community Guidelines, applicable law, or the safety of the platform.

Moderation may be performed using a combination of automated systems, user reports, and human review.

We may also restrict features, visibility, or access while investigating potential violations.

We do not guarantee that every violation will be detected or that all content will be reviewed.

9. Tarkify Intellectual Property

Tarkify and its original features, designs, software, branding, logos, visual elements, text, and other platform materials are owned by or licensed to Tarkify and are protected by applicable intellectual property laws.

Except as expressly permitted by us, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from Tarkify's proprietary materials.

Your use of Tarkify does not grant you ownership of Tarkify's intellectual property.

10. Third-Party Services and Links

Tarkify may integrate with or link to third-party services, websites, or applications.

Third-party services are not controlled by Tarkify, and their availability and use may be governed by separate terms and privacy policies.

Tarkify is not responsible for the content, policies, security, or practices of third-party services unless otherwise required by applicable law.

11. Service Availability

We work to keep Tarkify available, reliable, and secure, but we do not guarantee that the service will always be available or uninterrupted.

Tarkify may occasionally be unavailable because of maintenance, upgrades, security incidents, infrastructure issues, third-party failures, or circumstances beyond our reasonable control.

We may modify, suspend, or discontinue features of Tarkify as the platform evolves.

12. Account Suspension and Termination

You may stop using Tarkify at any time and may request deletion of your account where the applicable functionality is available.

Tarkify may suspend or terminate an account if we reasonably believe that the account:

• Violates these Terms
• Violates our Community Guidelines
• Creates a security or safety risk
• Engages in fraudulent or abusive behavior
• Uses the service unlawfully
• Attempts to manipulate or compromise the platform

Where appropriate and legally permitted, we may provide notice or an opportunity to appeal moderation decisions.

13. Disclaimers

Tarkify is provided on an "as available" and "as is" basis to the extent permitted by applicable law.

We do not guarantee that:

• The service will always be available
• All content will be accurate or reliable
• Every user or piece of content will comply with our rules
• The service will be free from errors or interruptions
• Any particular feature will remain available indefinitely

Opinions and arguments posted by users represent the views of those users and do not necessarily represent the views of Tarkify.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Tarkify and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Tarkify and its affiliates, officers, employees, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your User Content
• Your violation of another person's rights
• Your unlawful or abusive use of Tarkify

16. Changes to These Terms

We may update these Terms from time to time as Tarkify evolves or as legal, regulatory, or operational requirements change.

When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice where appropriate.

Your continued use of Tarkify after updated Terms become effective means you accept the revised Terms to the extent permitted by applicable law.

17. Governing Law and Disputes

These Terms and your use of Tarkify will be governed by the laws applicable to Tarkify's operating entity, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from or relating to these Terms or your use of Tarkify will be handled through the dispute resolution process and jurisdiction applicable to the Tarkify operating entity.
